LIMITATIONS OF CONTRACT This contract applies to the original puppy and is non transferable to a second party.. No replacement puppy will be given if the male or female has been bred. The Buyer is responsible for all transportation costs on original or replacement puppy.. Buyer is responsible for all Veterinary costs on original or replacement puppy. If for any reason the buyer is unable to keep, or care for, the above mentioned puppy and/or adult dog, the puppy and/or adult dog must be immediately returned to the breeder Charlotte Thomas. All expenses incurred in returning the puppy and/or adult dog will be the responsibility of the buyer.
HIP GUARANTEE TERMS AND CONDITIONS Puppies are sold with a 25 month hip Guarantee. Certifications accepted may be from Orthopedic Foundation for Animals (“OFA”) certification of hips & elbows (fair, good, or excellent), SV a stamp, or Penn HIP rating (pass). Buyer agrees to have hips and elbows xrayed by a licensed veterinarian at the age of 12 months and again at the age of 24 months. Xrays must be sent to “OFA” for “Preliminary Certification” at the age of 12 months and again for “Final Certification” at the age of 24 months. A copy of the results from OFA must be sent to the Breeder by the Buyer within one week after Buyer receives notification from OFA. Failure to do so will render the hip guarantee to be null and void.
REPLACEMENT Breeder (vom Haus Vianden) guarantees the dog will have a passing hip and elbow certification from a recognized registry. (i.e. SV, USA, OFA). If a passing hip & elbow certification is not obtained at the age of 24 months, the Breeder agrees to replace the puppy with one of equal quality from the first available litter after Buyer provides Breeder with notice from a licensed veterinarian that the dog has been spayed or neutered. The Buyer may keep said dog. The Buyer understands that all replacements costs, including (but not limited to) shipping expenses rest solely with Buyer.
PRICE AND DEPOSIT The price of this puppy shall be $ _________. A $500.00 deposit is required to hold a puppy for Buyer. If Buyer’s choice of color or sex was not produced, buyer will wait until the next litter for a puppy. There are no refunds of puppy deposits.
OTHER COSTS Buyer agrees to pay all costs associated with shipping; including, but not limited to, veterinarian checkup, health certificate, crate, water and food containers, and transportation to the airport. Costs are paid in advance prior to shipping of the puppy. If all funds are not received by the time the puppy is 9 weeks of age the buyer forfeits all rights to the puppy and the puppy will be sold to another waiting party. Breeder will retain all funds paid to date.
KENNEL NAME The puppy’s name shall include the name “vom haus Vianden” in registration. No other kennel name shall be used in naming this puppy.. . Buyer agrees that the puppy’s name will begin with the litter letter as assigned by the Breeder, and understands that the puppy may have a call name but must be registered with the assigned litter letter.
LEGAL Should either Breeder or Buyer take any legal action to enforce any part of this Contract, action shall be initiated in the State of Idaho, City of Post Falls.
